***** RAMENDRA JAIN, J. (ORAL) Prayer in this petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner in case FIR no.273 dated 20.12.2017, under Sections 420, 465, 468, 471 and 120-B IPC, Police Station Zira, District Ferozepur.

According to the prosecution, petitioner cheated the complainant-Zira Primary Cooperative Agricultural Development Bank for two loans, one of ` 4,00,000/- and another of `3,00,000/- totalling ` 7,00,000/-taken by his deceased-father, by forging a "no dues certificate".

Learned counsel contends that petitioner has falsely been implicated by the complainant-bank on the basis of alleged forged "no dues certificate". The same was never prepared by the petitioner. Out of SONIKA 2019.03.27 18:18 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-12037-2019 --2-- the total dues around `10-15 lakhs, the petitioner has already re-paid `2,15,000/- to the complainant. Thereafter, the complainant-bank refused to accept the payment from the petitioner. Having given thoughtful consideration, this Court finds instant petition completely merit-less being based on false hood, inasmuch as, on the last date of hearing, to show bona fide of the petitioner, his counsel had undertaken to produce demand draft of entire loan amount. But today, instead of doing so, and taking false pleas, the petitioner is out and out to usurp the loan amount obtained by his deceased-father, without caring his pious obligation to discharge the debt liability of his deceased father.

In view of the above, finding no merit in the instant petition. Dismissed.
