Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.5 dated 12.02.2016 under Sections 406 and 420 IPC, registered at Police Station Lambra, District Jalandhar.
Notice of motion.
Ms.Monika Jalota, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As argued, FIR is dated 12.02.2016. The present petitioner has been declared proclaimed offender on 07.03.2017 and he was arrested on 29.08.2018. CRM No.M-12081 of 2019 -2registered against the present petitioner, as argued by learned State counsel. The allegation against the petitioner is that he took `9 lakhs fraudulently for sending son of the complainant to foreign country. Keeping in view the facts and circumstances of the present case and in view of the fact that if the petitioner is released on bail, he may again abscond from the proceedings, I do not find it a fit case where petitioner is entitled to benefit of regular bail.
Therefore, finding no merit in the present petition, the same is dismissed.
Learned counsel for the petitioner has brought it to the notice of this Court that accused is not being produced from the jail. The Senior Superintendent of Police, Rural, Jalandhar is directed to look into the matter and to make every effort to produce the accused in the Court for the purpose of trial of this case.
