This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.254 dated 11.5.2016 registered for the offences under Sections 5 and 13(2) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Nuh, District Mewat.

Notice of motion has been issued in this case. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Additional Advocate General, Haryana appearing for the respondent-State HARPAL SINGH PARMAR 2016.07.28 14:19 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-22923 of 2016 and have gone through the record.

From the record, I find that the FIR in the present case has been recorded on the basis of a secret information. The present petitioner is not named in the FIR. It is stated that two persons had run away and they have been identified by the secret informer, but the name of the person who had identified has not been mentioned in the FIR nor the name of the present accused has been mentioned in the FIR.

Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I accept this criminal miscellaneous petition and in the event of arrest, the petitioner shall be admitted to bail on his furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
