....

Coram:

Hon'ble Mr. Justice Inderjit Singh .....

Present:

Mr. J.S. Jaidka, Advocate for the petitioner. .....

Inderjit Singh, J.

The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.49 dated 30.6.2016 registered for the offence under Section 295-A IPC at Police Station City-2, Malerkotla, District Sangrur.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the FIR in the present case has been got registered by one Mohammed Sharif. As per the allegations, the present petitioner sent a message to the group having Mohammedans also in that group in which against Profit Mohammed had been written. I have gone through the FIR. It is a very serious matter. Learned counsel for the petitioner states that the petitioner sent HARPAL SINGH PARMAR 2016.07.14 17:11 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-22924 of 2016 [2] the message as it is as received by him.

Keeping in view the nature and gravity of the offence and message that the Muhammed married his moonlike daughter Aisha etc. and she was kept hungry for 30 days etc. is a serious matter. Keeping in view the nature and gravity of the offence, I do not find it a fit case where the petitioner is entitled to the benefit of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
