*** SANDEEP MOUDGIL , J. (ORAL) This judgment will decide CWP No.7273 of 2022 as well as CWP No.17089 of 2022 as the same issues are involved therein. In the instant petitions, show cause notices dated 31.03.2023 and 25.07.2022 (Annexures P-6 & P-4) have been challenged. However, since the orders of reversion qua the petitioner in CWP No.7686-2019 stands withdrawn by the Municipal Corporation, Ambala and the petitioner-Parmod Kumar was promoted on 08.03.2019 entertaining the petition at this stage wherein the petitioners have not Ankur Goyal 2023.08.01 08:56 I attest to the accuracy and integrity of this order/judgment
CWP-7273-2022 --2-- 2023:PHHC:095391 CWP-17089-2022 2023:PHHC:095394 actually filed their reply to the show cause notices impugned in the instant petitions and approached this Court directly. Learned counsel for the petitioners fairly submits that they will file reply to the impugned show cause notices within a period of ten days from today to the Commissioner, Municipal Corporation concerned. Mr. Jagbir Malik, Advocate appearing on behalf of the Municipal Corporation, is not adverse to the said proposal made by Sh. Sunil Nehra, Advocate for the petitioners in both the petitions. Both petitions are disposed of with a direction that in case, the petitioners submit their reply to the impugned show cause notices dated 31.03.2022 (in CWP-7273-2022 as Annexure P-6) and dated 25.07.
2022 (in CWP-17089-2022 as Annexure P-4) within a period of ten days from today, the same shall be considered by the competent authority as per the rules applicable and in the light of the judgment rendered in CWP No.262 of 2018 within one month thereafter. The order so passed will be speaking and the same shall be communicated to the petitioners within a period of one week thereafter.
In view of the above, the instant petitions stand disposed of. A copy of this order be placed on the file of another connected case.
