**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 51 dated 06.4.2016 registered at Police Station District Gurgaon under Sections 376, 506, 34 IPC.
Counsel for the petitioner contends that the petitioner is in custody since 12.4.2016 and challan has been presented. Counsel also states that the victim had refused to get her medical done and has given an affidavit that she does not want to proceed with the case. Counsel for the petitioner further states that the matter was brought to the notice of the Court below as well. Counsel for the petitioner states that the allegations themselves reveal that it was a consensual relationship and prosecutrix admits to her relationship for the last two years and she is major. The allegations against the FIR are that there was a proposal for marriage but the accused had refused. The complainant is major and has been in the relationship for the last two years.
