The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.53 dated 19.3.2017 registered for the offences under Sections 307, 379-B, 279, 148 and 149 IPC at Police Station Basti Bawa Khel, Jalandhar Commissionerate, District Jalandhar. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that earlier anticipatory bail petition of the petitioner has been dismissed on merit by passing a detailed order dated 3.8.2017 by this Court. The present petitioner was stated to be armed with a `Datar' and gave simple injury on the head of Manni Hans-injured. Kulwinder Singh, co-accused was stated to have given the stone blow on the head of Manni Hans-injured, which has been declared as dangerous to life. Cr. Misc. No.M-23011 of 2018 [2] There are no changed circumstances in the present case to grant of anticipatory bail. The mere fact that the offence under Section 308 IPC instead of Section 307 IPC has been substituted, in no way, can be said as changed circumstance. It is a road-rage case where the Fortuner vehicle of the accused hit the car of the complainant and then these injuries were caused by the present petitioner and his co-accused to the injured. Keeping in view the above facts, I do not find any gound to grant anticipatory bail to the petitioner.
Therefore, finding no merit in this petition, the same is dismissed.
