CORAM: HON'BLE MR. JUSTICE RAVI SHANKER JHA, CHIEF JUSTICE HON'BLE MR. JUSTICE VIKAS BAHL

Present:

Mr. Varun Gupta, Advocate, for the petitioner.

* * * * RAVI SHANKER JHA, C.J. (ORAL) The petitioner had previously filed CWP-25254-2022 raising the same and identical issue and seeking quashing of the impugned rejection order/Work Load Return (WLR) dated 19.10.2022 (Annexure P-20) and the show cause notice dated 11.04.2022 (Annexure P-8) issued by the respondent-authorities. Learned counsel for the petitioner, after arguing at length, prays for withdrawal of the writ petition with liberty to pursue the matter with the respondentauthorities in accordance with paragraph 5 of the impugned WLR dated 19.10.2022 (Annexure P-20).

Admittedly, the petitioner has already done so and the matter is already pending with the respondent-authorities.

In the circumstances, the second writ petition for the same cause of action is not maintainable.

At this stage, learned counsel for the petitioner submits that he may be permitted to move an appropriate application before the respondent-authorities seeking early decision on its representation. It goes without saying that if the petitioner does so, the respondentauthorities shall look into the matter and take a decision in the matter in accordance with law expeditiously.

The writ petition, accordingly, stands disposed of as withdrawn. (RAVI SHANKER JHA) CHIEF JUSTICE (VIKAS BAHL) JUDGE 28.03.2023 Amodh Sharma Whether speaking/reasoned Yes/No Whether reportable Yes/No AMODH SHARMA 2023.03.29 15:46 I attest to the accuracy and authenticity of this order/judgement
