The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of communication dated 22.03.2023 (Annexure P-11) whereby their dealership of retail outlet has been terminated.

Mr. Ashish Kapoor, who on advance notice is present in Court, submits that there is arbitration clause in the dealership agreement, thus, petitioners should be relegated to Arbitrator. He further submits that disputed questions are involved which cannot be adjudicated by this Court. 3.
Faced with this, Mr. Abhishek Sethi, Advocate submits that with the consent of respondent, this Court may appoint an Arbitrator, so that matter may be finally settled.

With the consent of both sides, Justice H.S. Sidhu (Retired), House No. 15, Sector-2, Chandigarh (Mobile No. 8558809912) is hereby appointed as Anju Goel 2024.03.18 17:49 I attest to the accuracy and integrity of this document Chandigarh

The Arbitrator shall be entitled to fee as per schedule of the Arbitration and Conciliation Act, 1996 which shall be borne by both the parties in equal share. At the first instance, the parties would appear before him on 15.04.2024 and thereafter as directed by Justice H.S. Sidhu (Retired).
