Present petition is for grant of regular bail to the petitioner, namely Daljit Singh alias Kaka in case FIR No. 30 dated 24.3.2017, registered under Section 22/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 and prayer has been further made that meanwhile interim bail be granted till the receipt of report of Chemical Examiner. Learned counsel for the petitioner confined his prayer only to the extent of release of petitioner on interim bail. He further contended that petitioner was arrested on 24.3.2017 on account of alleged recovery of intoxicant powder, tablets, capsules etc and report of the Chemical Examiner has not been received as yet. Resultantly, co-accused Rajni was released on interim bail vide order dated 12.5.2017, passed by the Judge, Special Court, Kapurthala. Criminal Misc. No. M-22107 of 2017 of report of Chemical Examiner and he undertakes to surrender as and when the same is received.

Learned counsel for the respondent-State opposed the petition on the ground that alleged recovery is of commercial quantity and there is no ground to release the petitioner on regular bail. However, effort is made to obtain the report of Chemical Examiner at the earliest and even prayer for releasing the petitioner on interim bail be declined. Having considered the submissions made by learned counsel for the parties and the admitted position of the fact that report of Chemical Examiner has not been received as yet and co-accused, namely Rajni has already been released on interim bail as per order dated 12.5.2017, passed by the learned Judge, Special Court, Kapurthala, petitioner is also ordered to be released on interim bail on furnishing of bail bonds in the sum of ` 50,000/- with one surety in the like amount before the trial Court. Petitioner shall surrender before the trial Court on 9.10.2017. In view of above, present petition stands disposed of. (Shekher Dhawan) Judge July 06, 2017 "DK"
