IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CRM No.M-23002 of 2016 Decided on: 08.05.2017 Karaj Singh and another ....Petitioners
Versus
State of Punjab ....Respondent CORAM: HON'BLE MRS JUSTICE REKHA MITTAL Present :
Mr. Vikas Gupta, Advocate for the petitioners.
Mr. Ankur Jain, AAG, Punjab.
Mr. Bikramjit Arora, Advocate for respondent No.2.
REKHA MITTAL, J. (Oral) Counsel for the petitioners has submitted that on the basis of dispute being settled between the parties, a petition for quashing of the FIR and subsequent proceedings has been filed and is pending for 25.05.2017.
Counsel for respondent No.2 has submitted that though the dispute was settled between the parties by way of compromise but the petitioners have failed to comply with the terms and conditions of the compromise and even did not deposit a sum of Rs.5,00,000/- in compliance with the order dated 02.09.2016 passed by this Court. Counsel for the petitioners, in reply, would submit that an appropriate order may be made.
On 02.09.2016, this Court allowed interim bail to the petitioners and a direction was issued to them to deposit a sum of Rs.5,00,000/- in lieu of dowry with the trial Court within a period of Mohd. Yakub 2017.05.10 09:32 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-23002 of 2016 two months.
Counsel for the petitioners is not in a position to convince this Court that the petitioners have complied with directions issued by this Court.
On the contrary, counsel for respondent No.2 has made a positive assertion that the petitioners have not deposited the amount. As the petitioners have failed to comply with the directions issued by this Court at the time of allowing interim bail to them, the petitioners have dis-entitled them to seek pre-arrest bail, a concession to be allowed by the Court.
Dismissed.
