Prayer made in the present petition is for directing the respondents to grant the pensionary benefits under the Old Pension Scheme prior to 01.01.2006.

Faced with the fact that in para 5 of the preliminary submissions of the written statement dated 14.12.2021 filed by the respondents, it being clause 3 of the pension scheme prescribed the non-applicability thereof as also a petition i.e. CWP-916-2019, decided on 11.09.2023, regarding similar prayer, wherein liberty was granted to the petitioners to challenge the clause of pension scheme formulated by the University, in view of which learned counsel prays for withdrawal of the present petition with the same liberty. 3.
