Present:

Mr.Sanjeev Duggal, Advocate for the petitioner.

Ms. Shivali, AAG, Punjab.

*** LISA GILL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No. 82 dated 17.06.2016 registered under Sections 354/354-A, 354B, 323, 341, 506, 427 IPC at Police Station Division No.2, Ludhiana.

Learned counsel for the petitioner submits that the above said FIR has been registered in an absolutely malafide manner by clubbing two separate complaints filed by two different people. The said complaints are in respect of two different incidents having no connection with each other. It is submitted that the petitioner is a social activist and it is due to this reason that the petitioner has been implicated. Further-more he has joined investigations pursuant to order dated 19.08.2016 passed by this Court. Therefore, this petition be allowed.

Learned counsel for the State, on instructions from ASI Karanjit Singh, Police Station Division No.2, Ludhiana, affirms that the petitioner SUNIL DEVI 2017.03.17 12:18 I attest to the accuracy and integrity of this document

CRM-M-23026-2016 -2has joined investigation, no recovery is to be effected from him and his custodial interrogation is not required in this case. There are no allegations on behalf of the State that the petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances noted above but without expressing any opinion on the merits of case, it is considered just and expedient to allow this petition. Consequently, order dated 19.08.2016 is made absolute.
