This is a petition that has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus, directing the respondents to count service of the petitioner as Special Police Officer on daily wages rendered by him before regularization as qualifying service for the purpose of pensionary/retiral benefits, in view of the judgment rendered by this Court in CWP No.2371 of 2010 titled as Harbans Lal Vs. State of Punjab and others decided on 31.08.2010. In this regard, a representation dated 28.10.2021 (Annexure P-8) has been given by the petitioner to respondent No.2 but till date no decision has been taken thereon.

Without commenting on merits of the case, I dispose of the instant petition by directing the respondent No.2 to take a decision on the representation dated 28.10.2021 (Annexure P-8) of the petitioner in accordance with law within a period of two months from the date of receipt of certified copy of this order and convey the decision to the petitioner, failing which the officer responsible for the lapse would be liable to deposit costs of Rs.20,000/- from his personal pocket with the Punjab and Haryana High Court Advocates Welfare Fund.
