Due to COVID-19 situation, the Court is convened through video conference.

This petition, under Section 438 Cr.P.C., has been filed seeking anticipatory bail in FIR No. 122, dated 10th July, 2020, under Sections 379, 506 and 120-B IPC, registered at Police Station Sadar, Khanna, Police District Khanna, District Ludhiana.

This Court vide order dated 09th April, 2021, granted interim bail to the petitioners. The operative part of the order dated 9th April, 2021, reads as under:

"

Meanwhile, the petitioners shall join the investigation and would come present as and when called for PRASHANT KAPOOR 2022.02.10 17:36 I attest to the accuracy and authenticity of this document

CRM-M-15995-2021 and in the event of arrest, they shall be admitted to interim bail on their furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer, subject to deposit of bank draft of Rs. 8 lac drawn in the name of Registrar General of this Court, before the next date of hearing. The petitioners shall also abide by the conditions as specified under Section 438 (2) Cr.P.C."

Learned State counsel on instructions from ASI Amar Singh, submits that the petitioners have joined the investigation and also deposited Rs. 8,00,000/-. He further submits that the petitioners are required to join the investigation again.

Learned senior counsel for the petitioners submits that the petitioners shall continue to join investigation as and when called for. 6.

As no custodial interrogation is needed, the interim bail granted on 9th April, 2021, is made absolute, subject to the condition that the petitioners shall continue to join the investigation as and when called for. The amount of Rs.8,00,000/- deposited by the petitioners, shall be subject to the outcome of the trial. It is reiterated that the amount of Rs. 8,00,000/- be kept in a Fixed Deposit Receipt in a Nationalized Bank, awaiting conclusion of the trial.
