Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0162 dated 25.04.2018 under Sections 420, 120-B IPC and Section 13 of the Punjab Travel Profession Regulation Act, 2012, registered at Police Station Shimlapuri, District Ludhiana.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. CRM No.M-23111 of 2018 -2contacted the present petitioner and her husband for getting work permit at Canada. As per the allegations, `1000/- was deposited at first stage, then `5000/- was deposited and later on, `3,500/- was deposited. It is the case of the complainant that `25,000/- was also given but no receipt was issued by the accused. It is also in the FIR that present petitioner and her husband told the complainant that they will take amount of `3,80,000/- only when the complainant reaches Canada. No other FIR has been registered against the petitioners.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is allowed. It is ordered that in the event of arrest, the petitioner be released on bail subject to her furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, she shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
