Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.10 dated 23.01.2017 under Sections 147, 148, 149, 323, 324, 452 and 506 IPC (Setions 325 and 307 IPC added later on and also charged under Section 460 IPC), registered at Police Station Loharu, District Bhiwani.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that though in the FIR, general allegation regarding causing injury has been levelled against the present VINEET GULATI 2019.05.22 15:56 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-12289 of 2019 -2petitioner along with co-accused but learned State counsel contended that victim has stated that present petitioner was armed with gandasi and he gave gandasi blow on his head. He further contended that petitioner is the main accused, who has caused injury dangerous to life. Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that if the petitioner is released on bail, there is every chance of tampering with the evidence, I do not find it a fit case where petitioner is entitled to benefit of regular bail.

Therefore, finding no merit in the present petition, the same is dismissed.
