(ORAL) The petitioner is seeking the concession of anticipatory bail in FIR No.134 dated 24.12.2024 under Sections 118(1), 115(2), 305, 351(2), 191(3), 190 of the BNS, 2023, registered at Police Station City-2, Abohar, District Fazilka.

Vide order dated 05.03.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner inter alia contends that the only role attributed to the petitioner in the occurrence in question is of having inflicted an injury from the blunt side of the kappa on the knee of the complainant, which, in turn, opined to be simple in nature."

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 05.03.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
