Prayer made in the present petition is for quashing of order dated 23.11.2004, Annexure P-8, whereby after refixation recovery was to be effected, which the Division Bench vide order dated 16.12.2004 had stayed

Reliance in the index of the present petition was placed on the judgment passed in Darshan Pal vs. State of Punjab and others, CWP-165462003, wherein recovery had also been stayed, which stands decided on 10.02.2010 upholding the refixation, however, setting aside the recovery notice, which fact learned State counsel despite best efforts has been unable to controvert and resist disposal of the petition in terms thereof or cite any contrary law. 3.
