RAMENDRA JAIN, J. (ORAL) Custody certificate filed in Court today is taken on record. Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.0132 dated 22.11.2018 registered under Sections 379, 379-B and 411 IPC at Police Station City Fazilka, District Fazilka. According to the prosecution, on 22.11.2018, on the basis of secret information, police raided the disclosed place and recovered 15 stolen motorcycles, one scooty and three mobile phones from the petitioner and his three accomplice.

Learned counsel for the petitioner inter alia contends that coaccused of the petitioner namely, Baljit Singh has been enlarged on bail by the trial Court. Petitioner has falsely been implicated. He is the first offender. Petitioner is in custody since 22.11.2018. Conclusion of trial may take a sufficient long time. -2CRM-M-12082 of 2019 the petitioner any more in jail. Treating the case of the petitioner at par with his aforesaid co-accused, he may also be granted concession of regular bail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, treating the case of the petitioner on the same parity as that of his aforesaid co-accused, he is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
