Prayer in both the petitions is for quashing of FIR No.93 dated 20.12.2021 registered under Sections 498-A, 406, 506, 377 and 34 IPC at Police Station Woman, District Fatehabad (Annexure P1) and Challan presented on 13.12.2022 (Annexure P17) and all subsequent proceedings arising therefrom.

Learned counsel for the parties are ad idem that an oral settlement has been arrived at between the parties, as per which, a petition under Section 13-B of the Hindu Marriage Act, 1955 would be filed within next two weeks. As per the settlement, the petitioner (in CRM-M3423-2023) i.e. husband of the complainant, shall pay a sum of Rs.19 lakh in all to the complainant/respondent No.2/wife, of which a cheque for Rs.9 lakh has been handed over to the learned counsel for respondent No.2 in Court today, and photocopy of which is taken on record. Learned counsel for the petitioner(s) submits that Rs.5 lakh would be given to respondent No.2 at the time of recording of first motion statement in the Section 13-B petition; and remaining Rs.5 lakh would be given at the time of recording of second motion statement.

As stated above, learned counsel for the petitioner has handed over a cheque amounting to Rs.9 lakh, to learned counsel for respondent No.2 in the Court, who has accepted the same and has undertaken to give the same to respondent No.2 during the course of the day.

Learned counsel for the parties submit that as per the settlement, both the parties also undertake to withdraw all the pending litigations filed by them against each other; and except for the aforesaid agreed upon amount, no further amount shall be payable by the parties against each other.

In view of the above, learned counsel for the petitioner(s) seeks to withdraw the present petitions.

Permitted to do so.

In view of the above statements of learned counsel for the parties whereby they undertake to honour the terms of settlement agreed upon, both the petitions are dismissed as withdrawn. 8.
