(ORAL) Present writ petition has been filed for setting aside the order dated 26.10.2023 (Annexure P-9) passed by the Collector, Ferozepur Jhirka, Nuh and order dated 01.12.2023 (Annexure P-10) and further to grant the stay to the petitioner of order dated 26.10.2023 (Annexure P-9) during the pendency of the appeal before the learned Commissioner. Learned counsel for the petitioner has submitted that the petitioner filed an appeal along with the stay application before respondent No.2. However, the same has not been decided till date and the same has been adjourned for 20.03.2024. He further submits that even the stay application is also pending till date. Notice of motion to the official respondents at this stage. On asking of the Court, Ms. Upasna Dhawan, AAG, Haryana appears and accepts notice on behalf of the respondents-State. CWP No.6410 of 2024 -22024:PHHC:038119 She, however on instructions has submitted that the appeal filed by the petitioner along with the stay application is fixed for hearing on 20.03.2024 and the same would be heard on the date fixed. On hearing learned counsel for the parties and perusing the record, it is apparent that the appeal along with the stay application filed by the petitioner is fixed for consideration on 20.03.2024 before respondent No.2 i.e. Commissioner, Faridabad Division, Camp Nuh, District Nuh, Haryana.

In view of the facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.2-the Commissioner, Faridabad Division, Camp Nuh, District Nuh, Haryana to take up the appeal filed by the petitioner on the date fixed i.e. 20.03.2024 and hear the parties on stay application and decide the same expeditiously in accordance with law.
