(Oral) During the course of arguments, counsel for the State has brought to the notice of this Court that on 04.07.2014, charges were framed against the petitioners/accused before the trial Court, however, this fact was not brought to the notice of the Court by counsel for the petitioners, when notice of motion was issued by the Co-ordinate Bench of this Court and the trial Court was directed not to frame the charge against the petitioners on 07.07.2014.

Counsel for the State has further submitted that the case before the trial Court is now fixed for 26.09.2018 for recording the prosecution evidence, as the interim order was vacated on 11.05.2018. Faced with the aforesaid observations, counsel for the petitioners, at this stage, seeks permission to withdraw this petition with liberty to challenge the order framing charge against the petitioners/accused.
