******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.55 dated 23.05.2015 registered for offences punishable under Sections 406/120-B of Indian Penal Code, at Police Station City Jalalabad, District Fazilka.

Heard.

Learned State counsel on instructions from ASI Surinder Kumar submits that the petitioner has joined the investigation. Earlier FIR was cancelled as petitioner was found innocent. Now further investigation is in progress and recovery of money, as mentioned in the FIR, has not been effected from him.

Keeping in view the fact that earlier petitioner was found innocent, fresh inquiry has been ordered on the directions of senior police officer and that case is based on documentary evidence, this petition is allowed and order dated 29.05.2018 is made absolute till the presentation of JITENDER KUMAR 2018.09.10 15:33 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-23211 of 2018 -2challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
