Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Iqbal Singh, who has been booked for having committed the offence punishable under Section 394 read with Section 34, IPC, in a case arising out of FIR No.161, dated 25.10.2014, registered at Police Station, Sadar, District Ludhiana.

Learned proxy counsel contends that the petitioner is not named in the FIR; the co-accused of the petitioner have been granted bail by a Co-ordinate Bench of this Court; out of 16, three prosecution witnesses have been examined while four have been given up; the petitioner is behind the bars from 25.10.2014 and the prosecution is yet to conclude its evidence; the petitioner is neither required nor involved in any other case SEEMA RANI 2015.08.10 17:00

of similar nature and that the co-accused of the petitioner, who have been granted bail, have not misused the said concession. Though learned counsel for the State opposed the grant of bail to the petitioner in view of the serious allegations against him but could not controvert the factual position explained by learned counsel for the petitioner. After hearing learned counsel for the parties and going through the material available on record, the present petition is allowed. Petitioner-Iqbal Singh, s/o Sukhminder Singh, r/o village Aitiyana, P.S.Sudhar, District Ludhiana, is directed to be released on bail, during pendency of trial of the present case, subject to his furnishing bond in the sum of ` 1,00,000/- (Rupees one lac only) with one surety in the like amount to the satisfaction of learned trial court.
