This is a petition for grant of regular bail to the petitioner in case FIR No. 433 dated 27.9.2014, registered under Section 136 of the Electricity (Amended) Act, 2003 and Sections 457 & 380 IPC, at Police Station Kharkhoda, District Sonepat.
Learned State counsel has filed custody certificate of the petitioner by way of affidavit of Jai Kishan Chhillar, Superintendent, District Jail, Sonepat.
Learned counsel for the petitioner has argued that on the basis of one statement, alleged to have been made before the police, the petitioner has been impleaded in eight cases and of a similar nature and in two of those cases, he has been released on bail by this Court DEEPAK KUMAR BHARDWAJ 2015.08.25 09:56 I attest to the accuracy and authenticity of this document
Criminal Misc. No. M-22240 of 2015 vide orders dated 20.8.2015 passed in Criminal Misc. No. M-22117 of 2015 & Criminal Misc. No. M-22139 of 2015, respectively and on the basis of that parity, he should be released on bail in the present case as well since he is in custody for about seven months. Learned State counsel has not been able to deny the factual averments made above.
Keeping in view the entire factual matrix and the period of incarceration already suffered by the petitioner, without going into the merits of the case, I deem it appropriate to release the petitioner on regular bail to the satisfaction of the trial Court with the aforesaid caveat.
Ordered accordingly.
Petition stands disposed of in the above terms. Since the main case has been decided, the pending criminal miscellaneous application, if any, also stands disposed of. (Ajay Tewari) Judge August 24, 2015 "DK"
