RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for issuance of directions to respondent to complete the investigation and submit the final report under Section 173 Cr.P.C. in accordance with law in FIR No.140, dated 16.09.2017, under Sections 420, 467, 468, 471, 120-B IPC, registered at Police Station Ajnala, District Amritsar.
It has been contended by counsel for the petitioner that FIR was registered about five years ago and till date there is no progress in the investigation. He submits that as per the information, the complainant of the FIR has also died. He has submitted that the Investigating Agency is intentionally not proceeding with the investigation. Notice of motion.
On asking of the Court, Mr.Sandeep Kumar, DAG, Punjab, who is present in Court, accepts notice on behalf of the respondent/State and submits, on instructions from ASI Balwinder Singh that the matter is under MEENU 2023.03.22 15:54 I attest to the accuracy and integrity of this order/judgment
CRM-M-14370-2023 -2investigation and the same would be concluded expeditiously. However, after hearing counsel for the parties, this Court does not find any plausible reason for not completing the investigation in the last five years. The Senior Superintendent of Police, Amritsar (Rural), is directed to ensure that investigation is completed within four weeks from today. However, the petitioner is at liberty to approach this Court for redressal of his grievances, if need so arises/in case the investigation is not completed in the aforesaid period.
