Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.94 dated 13.06.2015 under Sections 336, 506, 148, 149 IPC and Section 25 of the Arms Act, registered at Police Station Gharinda, District Amritsar. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per allegations in the FIR, on 12.06.2015 at about 10.45 p.m., when the complainant Rattan Singh was about to sleep after taking meal in his house, suddenly one car stopped in front of the gate. CRM No.M-22291 of 2017 -2petitioner along with Jarnail Singh @ Raj and 2-3 other persons came in front of the house. Sonu raised lalkara in the street in front of complainant's gate that he would not be allowed to out of the house and as per allegations, the petitioners fired a shot in the air with the pistol which he was holding in his hand.

The petitioner has already joined the investigation. He is not required for custodial interrogation. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 20.06.2017 granting interim bail to the petitioner, is made absolute.
