Harbans Singh v. Satnam Singh And Another
CR-1731-2023 (O & M) -12023:PHHC:040553 In the High Court of Punjab and Haryana at Chandigarh CR-1731-2023 (O & M) Date of Decision: March 20, 2023 HARBANS SINGH .....PETITIONER
VERSUS
SATNAM SINGH AND ANOTHER ....RESPONDENTS CORAM: HON'BLE MR. JUSTICE ANUPINDER SINGH GREWAL
Present:
Mr.P.K. S. Phoolka, Advocate for the petitioner. **** ANUPINDER SINGH GREWAL, J (ORAL) The petitioner has challenged the order dated 24.02.2023 whereby the petitioner has been directed to produce the minor child on 3rd working Saturday of every month at 2.00 pm to 4.00 pm for meeting respondent No.1. Learned counsel for the petitioner submits that the respondent has filed a petition for custody of the child with a view to harass the petitioner, he has also preferred an application to produce the minor child for meeting respondent No.1 on each and every date of hearing. The daughter of the petitioner was married to respondent No.1 and due to harassment by the respondents, she is alleged to have committed suicide for which FIR had been filed and the matter is pending adjudication before the criminal Court. Heard.
The Family Court by the impugned order has directed the petitioner to produce the minor child on 3rd working Saturday of every month AMIT KAUNDAL 2023.03.20 16:51 I attest to the accuracy and integrity of this document Chandigarh
CR-1731-2023 (O & M) -22023:PHHC:040553 from 2.00 pm to 4.00 pm in ADR Centre, Bathinda. The mother of the child had unfortunately expired when the child is stated to be about 09 months old. Thereafter the custody of the child is with the petitioner, who is the maternal grand-father. The impugned order has been passed for permitting the child to meet her father. It would be necessary for the healthy development of the child that she is permitted to meet her father and obtain his love and affection. The petition for custody is pending adjudication before the Family Court. I do not find any illegality in the impugned order directing the petitioner to produce the minor once a month before the ADR Centre to meet her father. Consequently, the petition being without any merit and stands dismissed.
