(Oral) Prayer is for grant of anticipatory bail in case having FIR No.173 dated 4.5.2021 registered under Sections 395, 397 IPC and Section 25 of Arms Act at Police Station City Sohna, District Gurugram. The counsel for the petitioner submits that the petitioner was not named in the FIR and was nominated as an accused on the basis of disclosure statement made by co-accused Abbas. Counsel for the petitioner further submitted that the petitioner has joined investigation with the police in the light of previous order dated 7.4.2022 passed by this Court. ( 2 ) CRM-M-14671-2022 State counsel on instructions from ASI Krishan Chander has not disputed the fact that the petitioner was arraigned as an accused on the basis of disclosure statement of co-accused Abbas and that the petitioner has joined investigation and also submits that the petitioner is not required by police for further investigation or custodial interrogation. The State counsel further submits that recovery has already been effected in the present case. In view of the above and without commenting on the merits of the case, present petition is allowed and order dated 7.4.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
