Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0036 dated 24.02.2019 under Sections 365, 380, 427, 447, 457, 511, 506, 148 and 149 IPC, registered at Police Station Division A, District Police Commissionerate, Amritsar. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case was VINEET GULATI 2019.05.08 16:24 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-12278 of 2019 -2registered on the statement of complainant Ramesh Kumar, who stated that he has kept one person namely Rama Kant in his godown, who told him that Billo along with some unidentified persons came to the godown and threatened him and confined him and his family in one room of Deep Hotel and even took his mobile and switched off the same. There is also allegation that Billo along with his companions tried to usurp the property of the complainant and took away shuttering plates and other goods from his godown.

The petitioner has already joined the investigation. He is not required for custodial interrogation. No useful purpose will be served by sending and keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 18.03.2019 granting interim bail to the petitioner, is made absolute.
