By virtue of the present petition under Section 482 BNSS, petitioner, an accused in case bearing FIR No.93 dated 24.08.2025 registered against him, for commission of offences punishable u/s 3, 8, 13(1), 13(3), 17 of Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at P.S. Akera, District Nuh, has prayed for grant of pre-arrest bail. 2.

Status report/reply dated 01.04.2026 by way of affidavit of Mr. Prithvi Singh, HPS, Deputy Superintendent of Police, Nuh has been placed on record. In para 10 thereof, the factum of petitioner having joined the investigation has been mentioned. Learned State counsel, on instructions from SI Vijay Singh, submits that petitioner is not needed for further investigation.

On 16.03.2026, following order was passed by this Court:- "Petitioner, an accused in case FIR No.93 dated 24.08.2025 registered against him, for commission of offences punishable u/s 3, 8, 13(1), 13(3), 17 of Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at P.S. Akera, District Nuh, has prayed for grant of pre-arrest bail.

Learned counsel for the petitioner contends that the criminal proceedings were initiated in the present case on the basis of secret information, leading to recovery of two mouth of cows, 8 legs and 2 skin of cows freshly slaughtered and slaughtering weapons i.e. one axe, two knives, one sua, one electronic HAMANT 2026.04.02 19:59 I attest to the accuracy and integrity of this document

CRM-M-11973-2026 weighing machine, one tub, four motorcycles. Learned counsel contends that petitioner, who was not present at the spot, has been falsely implicated in the present case.

It is further the submission of learned counsel that petitioner is not the registered owner of any of the four motorcycles recovered at the site. Attention of the Court has also been drawn to the order dated 05.02.2026 (Annexure P-2) passed by the Coordinate Bench of this Court vide which similarly situated co-accused has been granted the concession of prearrest bail. Prayer is that on grounds of parity similar treatment be meted out to the present petitioner. Notice of motion.

Ms. Shweta Nahata, DAG, Haryana, accepts notice on behalf of respondent-State and seeks time to file detailed status report. Adjourned to 02.04.2026.

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.)." 4.

Keeping in view the fact that petitioner has joined the investigation, interim bail granted vide order dated 16.03.2026 is hereby confirmed, subject to conditions as envisaged under Section 482(2) BNSS. Further the petitioner is directed to join investigation as and when required in future by way of written notice for such purpose to be served by Investigating Officer of this case upon the petitioner; he will neither tamper with the evidence nor will influence the witnesses and nor will leave the country without prior permission of the Court. 5.

The petition stands allowed.
