CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR -.- JAISHREE THAKUR J. (ORAL) The Civil Misc. Application bearing No21647-CII of 2019 has been filed seeking to prepone the hearing of revision petition, which is now listed for 26.02.2020 and dispose of the same on the ground that the matter between the parties stands settled.

The application is allowed and with the consent of parties, the revision petition is taken up for hearing today itself. C.R. No.2027 of 2019 Counsel for the respondents contends that the matter has been settled between the parties before the Mediation and Conciliation Centre of this Court and settlement agreement dated 23.07.2019 has come into effect and in terms of settlement, the building has been vacated and possession of the same has been handed over. All arrears of mesne profits/rent also stand deposited with the Rent Controller.

Counsel for the petitioners does not dispute that possession has been handed over but would submit that an order be passed to the effect that respondents herein are at liberty to withdraw the amount so deposited in a fixed deposit before the Rent Controller.

Ordered accordingly.

The revision petition stands disposed of.
