The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 2 and 3 to re-issue him passport.

The petitioner applied for re-issuance of passport on Tatkal basis. He was issued notice to the effect that he has not disclosed name of his wife. On account of said fact, the passport was cancelled vide order dated 10.01.2024 (Annexure P-3). He filed fresh application dated 11.01.2024 wherein he disclosed name of his wife, however, in the column of marital status jotted down as 'separate'. He has filed petition under Section 13 of the Hindu Marriage Act before Family Court seeking divorce. his wife. He has filed self-declaration with respondents disclosing that matrimonial dispute is pending and he is staying separate from his wife. 3.

Notice of motion.

Mr. Prajwal Chauhan, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. He submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and thereafter, passport authority would look into grievance of the petitioner and dispose of his application within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 16.04.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 16.04.2024.
