(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.264 dated 29.09.2018, registered under Section 22-C of NDPS Act, 1985, Police Station Sadar Dabwali, District Sirsa. According to the prosecution, on the basis of secret information, 1950 intoxicant tablets and 200 capsules were recovered from the co-accused of the petitioner namely Raj Kumar @ Raju, who on interrogation, disclosed the name of the petitioner as his accomplice and that petitioner has also contributed `4000/- equally to purchase the said banned drugs.

Heard.

This Court is conscious of the fact that in several cases, in which person is not apprehended at the spot and is made accused on the basis of disclosure statement of arrested person, has granted the relief SONIKA 2019.03.20 17:56 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-12535 of 2019 --2-- of anticipatory bail, considering various factors i.e. small quantity of contraband recovered from his co-accused and various other factors. But, the case of the petitioner cannot be treated at par with those cases, considering the heavy recovery of contraband from the co-accused of the petitioner and also the fact that future career of the youth of the States of Haryana and Punjab is being ruined by such type of smugglers like the petitioner. Therefore, the petitioner does not deserve any concession of anticipatory bail.

Dismissed.
