The present petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) read with Section 528 of BNSS, 2023 seeking interim regular bail to the petitioner in case bearing FIR No.154 dated 05.08.10.07.2020 under Sections 302, 307, 341, 323, 506, 148, 149, 120-B IPC (Sections 103(1), 109, 126(2), 115(2), 351(2), 191(3), 190, 61(2) of BNS, 2023) registered at Police Station Sadar Samana, District Patiala. 2.
Learned counsel for the petitioner contended that the petitioner's mother is required to undergo knee replacement surgery and the petitioner is the only son in the family as his father is 72 years old, there is no other able-bodied member to take proper care of his mother during hospitalization and postoperation recovery and thus prayed for interim bail. 4.

CRM-M-11662-2026 -2opposed the grant of interim regular bail to the petitioner on the ground that the allegations against the present petitioner are grave in nature and 04 times, the bail of the petitioner has been denied by the Court. Learned counsel further contended that the petitioner has failed to bring on record any fact that except the present petitioner, there is none to look after his mother. It is further contended that in case the petitioner is released on bail, there is a genuine apprehension that the petitioner may abscond or flee from the process of justice and may further tamper with the evidence.

Keeping in view the facts and circumstances of the present case and contentions raised by learned counsel for the State and the fact that the petitioner is facing trial under Section 302 IPC and it is not a case of petitioner that except the present petitioner, there is none to look after his mother, as such, this Court is not inclined to grant interim bail to the petitioner and the present petition is hereby dismissed.
