Fearing for life and liberty at the hands of the private respondents no.4 and 5, the petitioner, invoking the fundamental right of life guaranteed under Article 21 of the Constitution of India, has come up before this Court seeking protection through the State.

On the last date of hearing, following order was passed by this Court:- "Notices served upon the official respondent(s) No.1 to 3 through the State's counsel.

Given the serious nature of allegations, respondent No.2 to constitute an SIT and produce the petitioner (name withheld being minor) before the nearest concerned Judicial Magistrate. On such production, learned Judicial Magistrate shall interact with the child and after that would either send her to Child Care Center or to her parents, as per the result of interaction and wisdom of such Judicial Magistrate. State to have instructions.

List on 08.04.2022. All the necessary actions be taken during course of the day.

CRWP No.3163 of 2022 In compliance of the aforesaid order, SIT was constituted and subsequently, the child was produced before the Judicial Magistrate concerned and custody of the child was handed over to her father and grand-mother. Given above, no further order is required to be passed. The petition is disposed of.
