SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.
Instant petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus for the release of detenues, mentioned in Para No.2 of the petition from the illegal custody of private respondents, who are running a brick kiln. Vide order dated 17.03.2020, this Court directed the appointment of a Warrant Officer to visit the places of detention of the alleged detenues and to submit a report before this Court, after recording their statements, if they are found in illegal detention. In compliance of the said order, report dated 20.03.2020 has been submitted by the Warrant Officer, wherein, it has been stated as under:- SAVITA KADIAN 2021.08.10 17:18 I attest to the accuracy and integrity of this document High Court Chandigarh
CRWP No.2790 of 2020 {2} "It is fairly submitted that undersigned alongwith petitioner Deepak, police party of the Police Station Pundari reached at Brick Kiln P.B.C. Situated in the area of the village Habri, Tehsil Pundari, District Kaithal on 18.03.2020 and 21 labourers including men, women and children released and custody given to the petitioner alongwith their belongings who left the Brick Kiln in a canter bearing number HR 45A 9355, which was arranged by the petitioner himself. In compliance to the orders of the Hon'ble Court common statement of the released labourers got recorded which is annexed at Flag 'X'. After release the custody given to the petitioner and his statement was also recorded which is annexed at Flag (Y). Brick Kiln partner Nassib not opposed the released of labour.
After release petitioner left the Brick Kiln with released labour and due entry has been made in DDR at P.S.Pundari at 11:12 P.M dated 18.03.2020. Undersigned returned to the Chandigarh and released labour accompanied upto Pehowa." In view of the above report, no further orders are called for. Petition is disposed of.
