The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

Mr. J.S.Warring, Advocate inter alia contends that petitioner was embroiled in FIR No. 28 dated 16.08.2009, under Sections 366, 376, 511, 34 of IPC, registered at Police Station City Tarn Taran, District Tarn Taran. The trial court found him guilty and awarded sentence of seven years. The sentence was awarded in 2012 and he filed appeal before this Court alongwith application seeking suspension of sentence. This Court vide order dated 17.05.2013 has suspended the sentence. He has filed application dated 14.11.2023 seeking re-issuance of passport. Mr. Hemant Hans, Central Government Counsel for Union of India submits that petitioner may be directed to appear before passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate, in accordance with law. 4.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 23.05.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 23.05.2024.
