NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C., is for quashing of impugned order dated 16.01.2014 (Annexure P-2) passed by the learned trial Court declaring the petitioners as proclaimed persons, in case FIR No. 20 dated 09.08.2011 (Annexure P-1) registered under Sections 406 and 498-A IPC at Police Station Women, Amritsar, Punjab and all subsequent proceedings arising therefrom on the basis of compromise deed dated 28.02.2021 (Annexure P-5). Perusal of the order sheets reveals that on 23.04.2021, when this matter was listed for hearing for the first time, a co-ordinate Bench of this Court while issuing notice in the present case had stayed the operation of impugned order 16.01.2014 (Annexure P-2), whereby the RISHU KATARIA 2024.04.08 18:37 I attest to the accuracy and authenticity of this order/judgment.
CRM-M-16964-2021 -22024:PHHC:046835 petitioners were declared as proclaimed persons by the learned trial Court. Thereafter, the matter was listed for hearing 03 times i.e. on 09.08.2022, 10.11.2022 and 15.03.2023, out of which on two dates i.e. 09.08.2022 and 10.11.2022, the case was adjourned at the request of learned counsel for the petitioners; whereas on the last date of hearing i.e. 15.03.2023, the petitioners have gone un-represented.
Today also, for the 2nd time the petitioners have gone unrepresented, despite the case having been called twice. Therefore, it can safely be presumed that the petitioners or their counsel are no more interested in pursuing the present petition.
In view of the above, the present petition is dismissed for non-prosecution.
