**** JAISHREE THAKUR, J. (ORAL) This Court was pleased to pass the following order on 23.06.2017 :- "This is a petition for grant of anticipatory bail to Surinder @ Sethi in case FIR No.134 dated 8.3.2017 under Sections 306/34 IPC and Section 3 of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, registered at Police Station Hansi City, District Hisar. The allegations in the FIR, registered on the complaint of one Krishan Kumar, are that his sister Saroj (since deceased) had a shop in Darra Bazzar Market. The accused including the petitioner wanted to grab the same illegally, for which they were harassing and torturing her. They had threatened that if the shop is not got registered in their name, the complainant and her family will have to face serious consequences.

Ld. Counsel for the petitioner states that the main accused, namely, Vinod Jain and Satish have already been granted bail by this Court. The allegations in the FIR are Satyawan 2017.09.05 18:05 I attest to the accuracy and authenticity of this document High Court Chandigarh

CRM-M-22502-2017 -2belied by the suicide note (Annexure P-3), wherein, the deceased is alleged to have stated that the accused had taken Rs.10,00,000/- from her and got a fake sale-deed registered in her favour., whereas, the said sale-deed is a genuine document. Notice of motion for 5.9.2017.

In the meantime, in the event of arrest, the petitioner Surinder @ Sethi shall be released on interim anticipatory bail to the satisfaction of the Arresting/ Investigating Officer, subject to the conditions provided under Section 438(2) Cr.P.C. The petitioner is also directed to join the investigation and cooperate with the Investigating Agency, as and when required."

Learned counsel for the petitioner submits that the petitioner has joined the investigation and two co-accused of the petitioner have already been granted bail.

Learned counsel for the respondent-State confirms the aforesaid fact.

Since the petitioner has joined the investigation and his two co-accused have been granted bail, the petition is allowed and interim order dated 23.06.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 05.09.2017 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
