The limited ground on which the parole application was rejected was that the house of the accused is close to the place where the victim is residing. On the previous occasion, counsel for the petitioner stated that victim has got married. 2.

Learned State counsel, on instructions from ASI Balbir Singh, states that the victim has not solemnized the marriage yet she has moved to Bihar to stay with her parents.

Once the victim has already shifted to Bihar the perceived threat on account of which the parole has been rejected i.e. the safety of victim on account of release of the petitioner, cannot be pressed to oppose the plea of parole. 4.

In such circumstances, the order impugned dated 11.11.2025. is quashed. The authority concerned is directed to release the petitioner on parole for a period of six weeks from the date of his release, subject to his furnishing adequate sureties to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate NEERAJ 2026.05.30 12:30 I attest to the accuracy and integrity of this document

CRWP-2403-2026 -2concerned. The Chief Judicial Magistrate/Duty Magistrate concerned shall be at liberty to impose appropriate conditions to ensure the petitioner's return to custody upon the expiry of the parole period.
