The petitioner is seeking the concession of anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) in case FIR No.143 dated 18.10.2024 under Sections 420 IPC, registered at Police Station Division No.2, District Pathankot.

On the last date of hearing on 06.03.2025, while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- " Learned counsel for the petitioner inter alia contends that in fact the petitioner was also a victim at the hands of travel agent, Tarlochan Singh, who had lured the petitioner into parting with a sum of Rs.1 lakh on the pretext of sending him abroad. In a similar fashion, said ARCHANA ARORA 2025.07.09 09:37 I attest to the accuracy and integrity of this document

CRM-M No.12747 of 2025 Tarlochan Singh had lured the complainant in the present case to part with some amount of money on the pretext of sending him abroad. Since Tarlochan Singh was unable to send the petitioner abroad and the latter was pressurizing him to return the amount given, Tarlochan Singh instead asked the complainant in the present case to transfer Rs.1 lakh into the account of the petitioner. Learned counsel submits that it is a matter of record that only Rs.1 lakh had been transferred into his account by the complainant which he is willing to repay." 3.

Learned counsel for the petitioner submits that in compliance of order dated 06.03.2025, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for her custodial interrogation.

In view of the above, the petition is allowed and interim order dated 06.03.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023. 3.
