[1] The matter is taken up for hearing through video conference due to COVID-19 situation.

[2] This petition under Section 438 Cr.P.C. is filed seeking anticipatory bail in F.I.R. No. 77, dated 2nd February, 2020, under Sections 420, 120-B and 506 IPC, registered at Police Station City Yamuna Nagar, District Yamuna Nagar.

[3] The allegations are that property beyond the share of the petitioner was sold by him. The parties were also involved in civil litigation, a civil suit was filed which was decreed on 16th January, 2009. On 19th March, 2020, the petitioner was granted interim bail subject to joining investigation.

CRM-M-11616-2020 -2- [4] Learned State counsel, on instructions from ASI Jitender Singh, submits that the petitioner has joined the investigation and his custodial interrogation is not required.

[5] Though the complainant has not been impleaded as a party, Mr. N.P. Bhardwaj puts in appearance on his behalf. He vehemently opposes the prayer for grant of bail on the ground that bail has been sought on the basis of revenue record which has not been updated. [6] Considering that allegations are based on documentary evidence, petitioner has joined the investigation and his custodial interrogation is not required by the investigating agency, the interim bail granted to the petitioner vide order dated 19th March, 2020 is made absolute.

[7] The petition is disposed of.
