Petitioner (Ramphal) has filed the present petition under Article 226 of the Constitution of India, for issuance of a writ in the nature of Mandamus, directing respondent No.2 to grant promotion to petitioner as Assistant in FPL-6, w.e.f. order dated 01.03.2024 (Annexure P-5) passed by respondent No.2; whereby the candidates junior to the petitioner were promoted despite petitioner being eligible, and to further grant all consequential benefits w.e.f. order dated 01.03.2024. 2.
At the outset, learned counsel for petitioner submits that she may be permitted to withdraw the instant petition with liberty to petitioner to approach the respondent-authorities for redressal of his grievances as raised in the present petition, by submitting a detailed representation. Learned counsel further submits that an appropriate direction be issued to respondent-authorities for taking decision on the representation, if filed, on behalf of petitioner, in a time bound manner. Mr. Harish Nain, Assistant Advocate General, Haryana appears on behalf of the respondent-State, in pursuance of the advance copy of paper book having already been supplied to him, and submits that in case any representation is filed by petitioner claiming any benefits, the same will be considered, in accordance with law, by the concerned authority and an appropriate speaking order will be passed.

Learned counsel for the petitioner submits that in view of the aforesaid submissions made by learned State counsel, no further grievance of petitioner survives at this stage.

Keeping in view the aforesaid submissions made by learned counsel for the parties, the present petition is disposed of with liberty to the petitioner to approach the concerned authority by way of filing a detailed representation, raising all his claims as raised in the present petition. If any such representation is filed by petitioner within three weeks from today, the same shall be considered and decided, in accordance with law, by the concerned authority within a period of four weeks from the date of receipt of the said representation. It goes without saying that in case petitioner is found entitled to any relief, the same shall also be released in his favour within a period of next three weeks of passing of the said order. 7.
