(ORAL) The petitioner, through the instant petition is seeking setting aside of order dated 21.02.2023 whereby Principal Judge Family Court, Sonipat has struck off defence of the petitioner. Learned counsel for the petitioner inter alia contends that Family Court has struck off defence of the petitioner on account of non-compliance of its order. The petitioner was directed to pay Rs. 3300/- towards litigation expenses. The petitioner is an illiterate person and with the help of some relative, he transferred a sum of Rs. 3000/- in the account of the respondent through google pay, however, respondent denied this fact. The petitioner has transferred aforesaid amount in the account which the respondent was maintaining. Without commenting upon allegations or counter allegations, the impugned order is set aside and petitioner is directed to file his reply alongwith statement of assests and liabilities before PARAMJIT KAUR SAINI 2023.03.21 16:33 I attest to the accuracy and authenticity of this order/judgment

CRR(F)- 423 of 2023 -22.5.2023 i.e. the date fixed before the Family Court. The petitioner shall pay costs of Rs. 5,000/- to respondent before 2.5.2023 and the said costs would be over and above the litigation expenses as awarded by Family Court.
