*** As per report received from Mediation and Conciliation Centre, the parties have resolved their dispute by amicable settlement/agreement. Copy of that settlement/agreement has been forwarded to this Court. The petitioner has been summoned as an accused in the complaint case. Under the circumstances, the custodial interrogation of the petitioner is not required and detaining him till conclusion of the trial shall not serve any purpose. Summoning of accused in a complaint case is to procure presence of the accused. Therefore, the petition is accepted and it is directed that on appearance of the petitioner in the trial Court in case in question he be released on pre arrest bail subject to conditions under Section 438(2) Cr.P.C..
The petition is allowed accordingly.
