NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 44 dated 13.03.2011 registered under Section 34,363 and 366-A IPC (challan report under Section 173(2) Cr.P.C. was filed under Sections 34, 363, 366-A and 376 IPC) at Police Station Gohana Sadar, District Sonipat. Learned counsel for the State has filed custody certificate dated 20.03.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 11 months and 09 days.

After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
