******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.119 dated 02.02.2018 registered for offences punishable under Sections 406/420 of Indian Penal Code, at Police Station Sector 7, Faridabad.
Heard.
Learned State counsel submits that the petitioner has joined the investigation and it has transpired during investigation that loan taken by the petitioner on his plot has not been repaid by him. Keeping in view the fact that payment of loan taken by petitioner from the bank is a matter in between petitioner and the bank and that petitioner has joined the investigation, completion of which then presentation of challan and conclusion of trial will take considerably long time, this petition is allowed and order dated 30.05.2018 is made absolute till the presentation of challan, subject to the following terms:- JITENDER KUMAR 2018.09.13 11:03 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-23583 of 2018 -2- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave India without the prior permission of the Court.
(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
