In view of no recovery having been made from the petitioner and similarly circumstanced co-accused having been released on bail, the petitioner can be granted the concession of bail as he has been in custody since 25.12.2015.

The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to an additional condition that the petitioner will not commit the similar activity, of which he is accused of, during pendency of the trial.
